Courage Scorecard: Federal Lawmakers:

ORIGINAL PRESS INQUIRY: Which proposed Higher Education funding solution(s) do lawmakers support? That was our original “Higher Ed” press inquiry (one “4-part” multiple choice question, below), sent out in 6 batches due to email rate limits.

UPDATE: During our news coverage of this, we discovered a startling phenomenon: Almost all GOP and Democrat lawmakers refuse to comply with key Higher Ed standards in their official party platforms, which, if left unchecked, threaten to crash the U.S. Dollar: College Debt, at almost ten (10%) percent of total U.S. Debt (divide $2t College Debt by the then $20t, or now, close to $30t U.S. debt). --Specifically:

(A) REPUBLICAN lawmakers: The Republican Party's official platform states this: “The federal government should not be in the business of originating student loans.”[[1]] However, how many GOP lawmakers are filing legislation to comply with this sensible prohibition on use of tax dollars to originate (make) student loans? Zero (unless you count S.323 and H.R.899, bills to terminate the Dept of Ed, but these bills have almost no chance of passing). Very odd.

(B) DEMOCRAT lawmakers: The Democrat Party's official platform states this: “Democrats will also empower the CFPB to take action against exploitative lenders and will work with Congress to allow student debt to be discharged during bankruptcy.”[[2]] However, how many Democrat lawmakers are filing legislation to comply with this sensible requirement to restore constitutional bankruptcy uniformity (Art.I, Sec.8, cl.4), a necessary Conservative Free Market check on excessive Education Department lending? Very few. (Democrats comply with their party platform a “little bit” more often than we Republicans do, but not much better.) Also, very odd. As a result of this new finding, my editor has directed me to open a formal investigation into this matter.

New Press Inquiry: The new press inquiry will tentatively ask lawmakers why they are not in compliance with their party platform, and then YES // NO, will they promptly file legislation to comply with their party's platform? If yes, when; if no, why not?

Further news coverage of this (including replies to both of our press inquiries, above) shall be posted in this space, below.

ORIGINAL PRESS INQUIRY (summary):Dear Lawmakers and staff:

As we've been giving ongoing coverage of the epic fail in American Higher Education funding, we've been informed by official sources that S.2598, an historic and landmark bill, is headed for markup at light speed, and, speaking only for myself, my gut feeling says that a related bill, H.R.4907, is shortly to follow, though we have no official word. In case you haven't heard of our organisation or myself, I'm the higher ed reporter & editor in chief of The Register, Conservative online news & Nat'l Dir., CONTRACT WITH AMERICA: PART II(TM), a nonpartisan research project patterned after Newt Gingrich's original CWA (though not affiliated), which advocates for bipartisan issues such as protecting the power/telcom "grid," cutting excess "pork" spending, and affordable college. We're working on a press inquiry to lawmakers inquiring where you stand on proposed solutions. We've found these four dominant in the political zeitgeist:

((A)) LIBERAL SOLUTION: Free College (like we do with taxpayer-funded Public Ed), and broad student loan cancellation.

((B)) STATUS QUO: College is excessively unaffordable to most; both taxpayer and student feel the crunch.

((C)) DE NOVO: New "repayment" programs or plans (such as S.2596, Sen Rubio's "LOAN ACT").

((D)) MIDDLE-GROUND COMPROMISE: S.2598, the current student loan bankruptcy bill with a modest 10-year wait period, claw-back accountability measures for "bad colleges," and a bill with twice as many GOP sponsors as Democrat, along with H.R.4907, which addresses Private Student Loans:

Below is the official Courage Scorecard, which we will be updating as appropriate -- either from responses given by lawmakers and/or we will “auto-populate” answers based on public info e.g., press releases, legislative record (sponsorship, voting record, etc.)

Gordon Wayne Watts: In late 2016, when I was working campaign “phone banks,” a high-ranking GOP leader arranged a personal meeting between me and Sen. Gordon Wayne Watts: On “Thu, Apr 15, 2021 at 4:48 PM,” I sent an email to Sen. FACTS: Sen. Cornyn is a new supporter of our bills; so, our responses should be supportive (as opposed to calling on him to act—he already is active).

UPDATE: This reporter recalls that Sen. Cornyn is on the Judiciary Committee hearing S.2598 markup, vividly recalls his supportive comments for S.2598. ** Sen. John Cornyn (R-TX), original sponsor of S.2598, FRESH START Through Bankruptcy Act, 116th Congress (2021-2022)

FACTS: Sen. Cruz neither opposed nor supported our bill in the recent committee hearing, but his lack of support is troubling, so we should politely but firmly push him to support the Constitution—which he has somehow miraculously memorised verbatim, word-for-word, I am told!

UPDATE: This reporter recalls that Sen. Cruz is on the Judiciary Committee hearing S.2598 markup, and vividly recalls his remarks against excessive waste in taxpayer-funded subsidies for higher education, but vividly recalls that he “side-stepped” declaring whether or not he supported S.2598 (to, for example, drive down lending and achieve this goal). This jury is still out on Sen. Cruz, but if he's memorised the entire US Constitution (and he has), we'd be surprised (and disappointed) if he refuses to comply with the BANKRUPTCY UNIFORMITY CLAUSE and support S.2598.

FACTS: Rep. Gaetz has been a supporter of our bills, but has been silent for some time, and didn't actually vote on H.R.2648 from last session, just spoke in committee in support; so, our responses should politely ask him to jump back on board.

UPDATE: This reporter recalls that Rep. Gaetz was on the Judiciary Committee which heard H.R.2648, last session, in markup, but can't recall whether he's weighed in on H.R.4907 this session. Rep. Matt Gaetz (R-FL-01), while not voting in committee, made the news in numerous venues for his strong support for H.R.2648, in which he held Rep. Kelly Armstrong (R-ND-AL) at bay and strongly defended S.2648, last session:

Franklin's office (202.225.1252 and local office: 863.644.1252) to follow up on my prior legislative requests sent by email or his website's “contact” form, and they probably know me by 1st-name basis. I occasionally comment on his social media too.

UPDATE: We've sent a press inquiry to this lawmaker, but, as yet, haven't received a reply, nor do we know the stance on S.2598 or H.R.4907.

UPDATE: This reporter recalls speaking with Higher Ed staff, William Sitton, who reported that Rep. Franklin doesn't, at this time, support the 2 student loan bankruptcy bills, S.2598 and H.R.4907, but, as yet, hasn't issued an official public statement, and invited me to make formal inquiry through the website portal.

Nadler, Jerrold

amy.rutkin@mail.house.gov, john.doty@mail.house.gov, daniel.rubin@mail.house.gov, hannah.weinerman@mail.house.gov, marcus.robinson@mail.house.gov

Gordon Wayne Watts: I submitted a press inquiry to Rep. Jerry Nadler Durbin (D-NY-10) and his HOUSE Judiciary Committee regarding H.R.4907 – the “private” student loan bankruptcy bill—including a copy of the written testimony I submitted to the SENATE Judiciary Committee regarding S.2598 – the student loan bill that gives relief to “public” student loans. LINK: https://GordonWatts.com/Press-Inquiry_Nadler_Durbin_PDF.pdf ARCHIVE: https://Web.Archive.org/web/20210819172944/https://contractwithamerica2.com/Press-Inquiry_Nadler_Durbin_PDF.pdf

Gordon Wayne Watts: On my honour, I did, indeed, follow up with polite and brief phone calls to inquire about the status of my press inquiry and request to submit written testimony, while also expressing my support for both H.R.4907 and S.2598, and assuring them that my legal scholar testimony would be helpful to them in getting much-needed support from “Conservative” lawmakers. (Additionally, as shown in the email linked above, I did include ALL 44 or so committee members by Bcc in my original email: I “PDF printed” my private copy which showed the Bcc line.)

UPDATE: This reporter recalls that Rep. Nadler is Chairman of the Judiciary Committee which heard H.R.2648, last session, in markup, and vividly recalls his strong support for it in committee comments--in fact, he's the chairman and was a primary sponsor of that bill, but has not weighed in on H.R.4907 as best I recall.
